§1 General Terms
Adam & Eve, Seestraße 6, 83209 Prien am Chiemsee, Germany (following "Knappe Stefan", "I" or "my-adam-eve.com" ), operates an Online-shop at the Web address www.my-adam-eve.com, where we particular offer fashion goods and fashion accessories for the purchase. These Terms and Conditions shall apply in the most recent version to all orders and contracts made by Knappe Stefan and the customer ("Customer", "Client", "Orderer" or "Purchaser"), who can be either consumer in the legal sense according to the German Civil Code §13 - BGB ("consumer") or trader in the legal sense according to the German Civil Code §14 - BGB ("contractor", "trader") and have to be of legal age in either case. No subsequent agreement in any way altering these Terms & Conditions shall be binding on Knappe Stefan unless made in writing and signed by an authorized officer of my-adam-eve.com.
§2 Important Information
1. The offered goods at www.my-adam-eve.com are represented clearly and extensively according to reality at the webpage. Due to screen, grafic and/ or printer settings the color and structure of shown object can vary from the original, my-adam-eve.com is not in the position to give you a garantee in the case of pictures and colours which the customer gets to see on his or her screen.
2. Please note that the represented products at www.my-adam-eve.com are possibly be out of stock or vary in prices at the time the customer attends the web page. The indicated prices are illustrated in Euros, including VAT (sales tax) and excluding shipping and handling (mailing expenses).
3. All ordered products are provided with a reimbursement label (one-time seal) and will be delivered like this. If you try something of the ordered Goods on, attent to not rip of or damage the reimbursement label. We advise specificly that we are not obliged to take back the product, if the reimbursement label is ripped of or damaged. Furthermore we can only accept returned goods, if they are returned in the original wrapping. We only accept shoes, if you send them back in the original cardboard shoe box (cardboard shoe box is part of the designer product). If you get a product without our reimbursement label, please contact us right away at +49 8051 5655.
4. My-adam-eve.com Terms of delivery: Partial deliveries are allowed.
§3 Conclusion of an Agreement
1. A contract between you and my-adam-eve.com is accomplished by filling in the order form available on our Web page, sending this form (binding offer by the customer/orderer) and accepting the offer by my-adam-eve.com, with receiving of the declaration acceptance by your E-Mail_Adress dedicated E-Mail Account or by supplying the ordered goods. In the order form, the customer accepts the ” General Terms and Conditions for the my-adam-eve.com” as an integral part of the contract.
2. If the distributor does not deliver your ordered goods to us, we are authorized to withdraw from the contract. In this case we will inform you right away that the ordered product is not available. If you paid the purchase price allready, we refund you forthwith as soon as possible.
3. My-adam-eve.com is authorized to refuse an offer without giving any reasons, particularly if a jstified suspicion exists that the goods ordered over the Internet getting will be sold again commercially.
§4 Consignment and Shipping
1. All deliveries will be handled exclusively by the Logistic Service Provider DHL. The General Business Conditions of DHL are an important component of these Terms Of Business and you can look them up at www.dhl.de.
2. Unless otherwise expressly agreed the delivery starts at the warehouse and ends at the delivery address/ship-to-address (address we received from the orderer). Optional informations about the period of delivery are without obligation, unless aspecific delivery date is obligated as part of the contract.
3. Dutiable/Taxable Deliveries
The period of delivery to dutiable/taxable countries is in general 2-4 business days. Please consider that we carry the costs of the house to house transport, the insurence of the goods and the customs clearance. DHL is charging the addressee separately for the arising expenses like import sales/purchases tax and maybe customs dues. Please note, that you maybe have to pay foreign bank charges. All deliveries into such countries (Switzerland for example) it concerns with the indicated prices of the articles net prices. (Minimum order value for delivering to Switzerland because of organisational reasons is € 200,00!)

Zone 3 - World
The World category includes countries such as:
Egypt, Algeria, Bahrain, Iraq, Iran, Israel, Yemen, Jordan, Canada, Qatar, Kuwait, Lebanon, Libya, Morocco, Oman, Saudi Arabia, pc. Pierre and Miquelon, Syria, Tunisia, the USA, combined Arab Emirates.
Zone 4 - Rest of World
These are all countries which are not listed in the other three Zones. If your country is not listed in one of these regions, then it is located in this Zone 4.
5. If the customer wants a special way of delivery method (e.g. express delivery), the customer have to bear the expenses for the extra additional costs, levied by the appropriate current price list of DHL. The transport risk is transferred to the customer as soon as the haulage contractor hands it over, unless the ordering party is consumer and the order is a consumer goods bargain.
6. In the case of partial shipment the delivery costs will be charged just once.
§5 Payment
The payment of your order at my-adam-eve.com is possible by prepayment or credit card.
Payment in advance (Prepayment)
- First you get our bank details and the purchase order number by an acknowledgement e-mail.
- Please remit the amount indicated on the purchase order number to our account.
- By prepayment you have to remit right after ordering. The acceptance of the contract and the shipment takes place as soon as my-adam-eve.com receives the payment. If the transfer of the purchase price does not take place within 5 buisiness days after the order and my-adam-eve.com does not receive the amount, my-adam-eve.com has the admission to cancel the order.
- We process your order right after payment is received. The period of delivery extends by 2-5 business days according to the transfer term.

If the ordered goods are not immediately available, we will refund the in advance transferred amount immediately, in this case it does´n effect your credit card charge.

§6 Reservation of Proprietary Rights / Conditional Sales Contract
The supplied good remains the property by Stefan Knappe (my-adam-eve.com) until the complete payment is received.
§7 Instruction on the right of withdrawal and the right to exchange or return
1. The customer can recall its order within two weeks without indicating the reasons why. The revocation should take place in text form e.g. by fax, letter or E-Mail. Besides it is possible for the customer to return or exchange the received regular or reduced goods without indicating the reasons why within two weeks. The period begins with receipt of the goods. For keeping the terml it is enough to send off the goods in time (date of the postmark) or the cancelling demand. The return takes place at expense and danger from my-Adam-eve.com, if all guidelines for the return were considered. In addition the free DHL return service is available. The revocation guidlines are attached to the received goods in writing. The goods must be returned to the following address: Adam & Eve, Seestraße 6, 83209 Prien am Chiemsee, Germany.
2. The return to my-adam-eve.com can only take place after a goods returned number (RAN) for authorizing was communicated to you by E-Mail. You get a RAN, if you send a E-Mail to ran[at]my-adam-eve.com. The RAN number conveyed by E-Mail must be claerly noted on the package.
3. The goods must be sent back to my-adam-eve.com in only one transmission/package. We reserve ourselves the right to reject several returns at different times from the same order. If all conditions of these General Terms and Conditions are fulfilled, we will refund the entire purchase price of the returned products less forwarding expenses. If not all mentioned conditions of these General Terms and Conditions were fulfilled, we will inform you accordingly. You than have then the possibility of receiving the returned articles again. Unfortunately we cannot take over additional forwarding expenses resulting thereby. Should you refuse the acceptance of the back dispatch, we reserve ourselves the right to retain the respective articles and the purchase price.
4. An exchange can take place only for the same article into another size. Please contact us by telephone or by E-Mail (service[at]my-adam-eve.com) to reserve the article in the desired size, if it is still available. A conversion into another article is not possible. The article will be sent to you, as soon as the returned article is received and controlled by us.
5. Please note that we can onlyaccept returned products, which are sent back in a perfect condition and to which our reimbursement label are fastened. Shoes are only accepted if you returned them in the original cardboard shoe box (cardboard shoe box is part of the designer product).
6. If an order is revoked, any goodseffected shall be returned and/or reimburse any payments received under the contract/agreement and compensation for the capitalised use if necessary get restituted (e.g. functional advantages). With degradation of the goods these cannot be taken back. You can avoid that, by treating the goods not like an owner in use and omit everything, which impairs their value. This does not apply if the goods are damaged upon their initial examination - as it would have been possible for one to do at the store - is to be lead back. If the goods are used, carried, washed, damaged or the reimbursement label isn´t attached anymore with the marked seal (one-time seal), there is an obligation for value replacement up to 100% of the purchase price.
7. Please note that there are maybe 10 - 14 days between the arrival of your returns and the refund procedure. After we receive your returns and ensure the returned items meet all requirements, you will receive a credit note by E-Mail from us. The time of the payment refunding depends on the respective credit card. It normally takes place within two credit card deductions. If according to the order the "ship to" person is not the same as the "bill to" person, the deducted amount always returns to "bill to"card holder. With pre payment, refunding takes place in genral within 10-14 days. Please remember that mailing expenses will not be reimbursed.
§8 Liability / Warranty
1. Product descriptions, designs, illustrations, technical data, instructions, weight -, measurement and performance specifications, which are contained in catalogs, circulars announcements, folders or price lists, have a absolute informative character. We do not take over guarantee for the correctness of this data.
2. Articles with obvious material or manufacturing defects (including transport damages), must to be lodged a complaint immediately with us under our E-Mail: kontakt[at]my-adam-eve.com or by fax: +49 (0) 80 51 - 30 93 96.
3. It applies the legal warranty law. Afterwards we first have the right to repair/replace the goods, if this fails, the customer can reduce the purchase price or withdraw from the contract. Possible claims for damages remain unaffected by it.
4. Listed below are additional exclusions - regardless of which legal reasons - for which my-adam-eve.com is not responsible. My-adam-eve.com is not responsible for for damage, which did not develop prior to delivery, especially my-adam-eve.com is not responsible for lost profits or for other financial damages of the orderer. As far as the adhesion is excluded from my-adam-eve.com or limited, this applies also to the personal adhesion of employees, representatives and fulfilment/other assistants of Stefan Knappe (my-adam-eve.com). The preceding limitation of liability does not apply, as far as the cause of the damage is based on resolution or rough negligence or a personal injury occurs. Furthermore it does not apply if the orderer makes valid §§1.4 product liability law complaints. If my-adam-eve.com neglgects a substantial contract obligation, the liability for compensation is limited to this specific incedent.
5. As far as a warranty defect is present, you are justified in the context of the legal regulations to require supplementary performance withdraw from the contract or reduce the purchase price. The replacement of consequential damage is barred. By the way following restrictions apply. For other than by injury of lives, bodies and health accruing damage we adhere so far as these are caused by deliberate or roughly negligent acts during a substantial contractual obligation by us or our executing aides (e.g. the delivery service). A liability of compensation, going beyond this, is impossible. The regulations of the product liability law remain unaffected by it; beyond that the adhesion for deceit or concealing damages as well as for the expressly guaranteed conditions remain unrestricted. After the present state of the art data communication over the Internet cannot be ensured to run perceis and/or be at any time available. We are liable neither for the constant and continuous availability of our Online Shops nor for technical and electronic errors during an order procedure, on which we do not have influence, in particular not for the delayed processing or acceptance of offers. If there are links to other web pages or sources provided, we are not responsible or liable for the availability of such external Sites or sources. We not make the content accessible on such web pages or sources ourselves, and are excluded from any responsibility or guarantee regarding these, as far as no positive knowledge of the illegality of their contents in individual cases exists.
§9 Data Protection / Data Privacy
1. All personal data are kept confidentially as a matter rof principle.
2. According to §28 BDSG (Federal Data Protection Law) we would like to point out that in the context of the transactions the necessary data are processed and stored by an EDP system in accordance with §33 BDSG. Personal data are levied only for specified, clear lawful purposes and are not kept longer than necessarily from my-adam-eve.com.
3. Customers’ are granted privacy and the right to authorization, blockage and deletion of its stored data by my-adam-eve.com. It is possible for the customer to communicate his demand at my-adam-eve.com by E-Mail (service[at]my-adam-eve.com), by post or fax.
4. My-adam-eve.com does not pass on personal data to third parties of the customer including its house address and E-Mail address. The service partners of my-adam-eve.com are excluded of it, which need the transmission of data for the order handling. In these cases the range of the conveyed data is limited to the necessary minimum.
§10 Final Clause
1. German rights apply under exclusion of the UN Kaufrechts (CISG). This also applies, if the customer has his/her general court of jurisdiction abroad.
2. So far as the customer is a tradesman, a legal entity of the public right or a public special estate, Traunstein is the exclusive court of jurisdiction for all contractually related disputes wether resulted directly or indirectly.
3. Should be or become one or more regulations of these trading conditions ineffective, then the effectiveness of all other regulations or agreements is not affected.
