1. Scope

The sole proprietorship adam & eve, represented by the owner and managing director of the same name, Mr. Stefan Knappe, Seestraße 6, 83209 Prien am Chiemsee, (hereinafter “we” or “my-adam-eve.com”) operates under the Internet address www.my -adam-eve.com an online shop, through which accessories and fashion items in the premium range are offered for sale.
The listed general terms and conditions (GTC) apply to any related legal relationship between my-adam-eve.com and the customer or orderer, who must be of legal age in any case and in this regard either "consumer" within the meaning of § 13 BGB or "entrepreneur “ within the meaning of Section 14 of the German Civil Code.
The customer acknowledges the validity of these General Terms and Conditions (GTC) during the ordering process by clicking on the “Accept General Terms and Conditions” button (I have read the General Terms and Conditions and I expressly agree to them)!
We do not recognize any terms and conditions of the customer unless my-adam-eve.com has previously expressly agreed to their validity in writing.

2. General important information

2.1 Presentation of Goods


The products offered on the website www.my-adam-eve.com largely correspond to reality and are presented in a clear and concise manner. However, my-adam-eve is not able to guarantee complete correspondence with reality due to different graphics, screen and printer settings of the customer's screen.
2.2 One-time Seal

All products ordered from www.my-adam-eve.com are marked with a one-time seal and delivered to the customer. When trying on the item you have ordered, please be careful not to damage the one-time seal, as this is the same as a refund seal. If the one-time seal or refund seal is damaged or removed, we expressly point out that we are not obliged to take back the goods and refund them.
2.3 Prices & Stock of Goods

www.my-adam-eve.com expressly points out that the prices and stocks of the products presented in the online shop may have changed at the time of the customer's visit.

3. Conclusion of contract

The presentation of the goods in our online shop www.my.adam.eve.com does not represent a binding offer (in the sense of § 145 BGB) only when the customer places an order does the offer become binding. By completing and sending the order form provided on our website to us, www.my-adam-eve.com , you are making a binding offer to conclude a purchase contract with us.

After we have received your order, you will be notified by email. The sales contract between you and www.my-adam-eve.com is only concluded when we accept the offer by sending/delivering the goods you have ordered. With the payment method "payment in advance", the delivery will only take place after the full amount has been received in our account.
my-adam-eve.com is entitled to reject an offer on your part without giving reasons, in particular in the case of justified suspicion of commercial resale of the goods purchased via the Internet. Contracts are concluded exclusively with the company my-adam-eve.com, whereby "the contract language is German".

3.1 Withdrawal

We are entitled to withdraw if the supplier (supplier) does not supply us with the goods you have ordered. In this case we will inform you immediately that the product you have ordered is not available.

4. Delivery and Shipping

4.1 Delivery


Unless otherwise agreed with the customer, delivery is made from stock to the delivery address specified by the customer.

4.2 Shipping Costs


The prices stated on my-adam-eve.com at the time of the order are decisive. This is the gross price, which means including the respective statutory sales tax and excluding any shipping costs that may arise.

4.3 International Delivery


4.3.1 Delivery on DDP basis (Delivery Duty Paid)

Deliveries are made to the countries listed below via the DDP (Delivery Duty Paid) service. This means that the purchase price includes all transport costs, import sales tax and customs duties. We ask that you contact us immediately if you are mistakenly asked to pay additional fees by one of our logistics partners.

4.3.2 Delivery on DDU basis (Delivery Duty Unpaid)


Deliveries to the following countries are handled using the DDU (Delivery Duty Unpaid) service. Please note that the price of goods stated in our online shop does not include duties and taxes. The recipient will be billed separately by the courier service for the applicable import sales tax and any customs duties. Since we cannot estimate these costs, we ask you to contact the responsible customs authority. My-adam-eve.com bears all costs for door-to-door transport, insurance of the goods and the costs for accompanying documents. Please note that you may have to bear any foreign bank charges.

4.3.3 Delivery to Switzerland and Liechtenstein


Experience has shown that the delivery time to Switzerland and Liechtenstein is 2-3 working days. Please note that we bear any costs for accompanying documents and insurance of the goods. Our item prices include the VAT applicable in Switzerland as well as customs and handling fees, but do not include German VAT. In the case of a return, customs and handling fees can only be reimbursed in the form of a voucher.

4.4 Delivery national


Our deliveries within Germany are always carried out by the DHL parcel service. National shipping (Germany) is €8.50 including free return (return).
DHL: Delivery to a Packstation within Germany is possible. Large parcels that do not fit in your rented parcel compartment may have to be picked up from Deutsche Post or a DHL Express station. You can read the terms and conditions and the additional application of DHL at www.dhl.de.

4.6 Special Shipping Method


If the customer (orderer) requests a special type of shipping (e.g. express delivery), he shall bear the additional costs incurred for this in accordance with the valid DHL price list. The transport risk is transferred to the customer when the goods are handed over to the carrier, unless the orderer (customer) is a consumer and the order represents a purchase of consumer goods for him.

5. Payment

The customer can pay the purchase price as well as the shipping costs for the ordered item with the help of advance transfer (advance payment), PayPal, SOFORT transfer or credit card. If an ordered item is not available, the amount already transferred will be refunded immediately or credited to the corresponding credit card.
Please note that some banks may charge separate transfer fees for transactions from abroad, although this only needs to be clarified with the respective bank. But this is completely independent of my-adam-eve.com.

5.1 Advance transfer (payment in advance)


The advance transfer must be made immediately after completing the order. The acceptance of the contract as well as the dispatch take place only after receipt of payment. If my-adam-eve.com does not receive the transfer of the purchase price and shipping costs within 5 working days of the order, my-adam-eve.com is entitled to cancel the order.

5.2 Paypal


If you select the PayPal payment method during the ordering process, you will then be forwarded directly to PayPal's own website. If you do not have a PayPal account, you have the option of opening one during the payment process. For more information, please visit www.PayPal.com .

5.3 Credit Card


The information required for credit card transactions, such as the card number, cardholder, expiry date, etc., is automatically forwarded in encrypted form, without my-adam-eve.com or third parties having any access to it. This financial information will never be used again, except for refunds on any returns. Please note that this is a direct debit.

5.5 Set-off


Offsetting by the customer is excluded unless the counterclaim has been legally established, is undisputed or ready for a decision, or includes a claim for compensation based on the costs of remedying defects from the same contractual relationship.

5.6 Right of retention


A right of retention and a right to refuse performance of the buyer with the exception of undisputed, legally established counterclaims or claims for the removal of defects from the same contract are excluded in commercial transactions.

6. Retention of Title

The delivered goods remain the property of my-adam-eve.com until full payment.

7. Liability & Warranty

7.1 Warranty


The statutory provisions apply to claims due to defects in the delivered goods, with the exception that a claim for damages due to defects only exists in accordance with 7.3 below. Illustrations, technical data, drawings, information, descriptions of weight, dimensions and performance contained in circulars, advertisements, brochures, catalogs or price lists are of a purely informative nature. my-adam-eve.com assumes no liability for the correctness of this information.

7.2 Statute of Limitations


The limitation period for statutory claims for defects is 2 years and begins on the date of delivery (receipt) of the goods by the buyer. We ask that you report a visible manufacturing, material or transport defect immediately, but this is not a prerequisite for the effective assertion of warranty claims.

7.3 Liability


If there is a defect subject to warranty, you are entitled within the framework of the statutory provisions to demand subsequent performance, to withdraw from the contract after failed subsequent performance, to reduce the purchase price or, in the event of fault on the part of my-adam-eve.com, to claim damages. We are only liable for damage other than damage to life, limb and health if this is due to intentional or grossly negligent action or culpable violation of a material contractual obligation (so-called "cardinal obligation", this means such an obligation, the fulfillment of which requires the proper execution of the contract contract is made possible in the first place and on the observance of which the contractual partner regularly relies and may rely) by us or our vicarious agents (e.g. the delivery service).
Any further liability for damages is excluded.

We do not adopt content that is accessible on such websites or sources as our own and exclude any liability or warranty in relation to it, unless positive knowledge of the illegality of the content exists in individual cases.

8. Withdrawal & Returns

The right of withdrawal applies exclusively to consumers in accordance with Section 13 of the German Civil Code. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.


8.1 Right of Withdrawal


You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.

In order to exercise your right of withdrawal, you must send us a clear statement (e.g. a letter sent by post or e-mail) about your decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.



8.2 Consequences of revocation


If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract.

For this repayment, we use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you. Under no circumstances will you be charged any fees for this repayment.

We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods to us, my-adam-eve.com, immediately and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. We bear the costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

End of revocation

8.3 Voluntary Right of Return


Irrespective of your statutory right of withdrawal, we, my-adam-eve.com, offer you the option of returning all products to us within 14 days of receipt of the goods without giving a reason. However, this right of return only applies to unworn, unwashed and flawless products from which all labels (hang tags, one-time seals, etc.) have not been removed.

8.3.1 Return


We will bear the costs of returning the goods, provided the following provisions are observed. The return of the goods takes place exclusively with the shipping service provider through which the package was delivered (DHL), whereby the waybill or return slip in the package must be used. Your package comes with all the documents that can help you with the return. In the event of a return, a credit will be made to your account, with any losses due to currency fluctuations not being reimbursed. Please note that we can only accept returns from the respective delivery country. This means that if the delivery was made to Italy, for example, the return may only be made from Italy.

9. Final Provisions

9.1 Governing Law


German law applies exclusively to all legal disputes arising from or in connection with the purchase contract, excluding the UN Sales Convention (CISG).

9.2 Jurisdiction


If the customer is a merchant, a legal entity under public law or a special fund under public law, Rosenheim is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.

9.3 Invalid Terms and Conditions


Should one or more of these provisions be or become invalid, this shall not affect the validity of all other provisions or agreements. Instead of the invalid provisions, the corresponding statutory provisions apply.
